We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe that any content on this website infringes your copyright or other intellectual property rights, please submit a notice using the procedure below.

A. Procedure for reporting intellectual property infringement

It is NCAA Store Online’s policy to (1) remove or disable access to content that we believe in good faith is infringing after we receive a compliant notice, and (2) take appropriate action against repeat infringers where applicable.

If you believe that content available on or through this website constitutes copyright infringement, please send a notice of infringement containing the following information:

  1. Identification of the copyrighted work (or other intellectual property) that you claim has been infringed, including registration number(s) if applicable.
  2. Identification of the material you claim is infringing and information reasonably sufficient to permit us to locate it (for example, the URL of the page where the material appears and a description of the specific content at issue).
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
  6. Your physical or electronic signature (or the signature of a person authorized to act on your behalf).

B. What happens after we receive a compliant notice

After we receive a properly submitted notice, we may:

  1. Remove or disable access to the allegedly infringing material.
  2. Notify the party associated with the material (if applicable) that the material has been removed or disabled.
  3. In appropriate circumstances, restrict access for repeat infringers.

C. Counter-notification procedure

If you believe that material you posted or that is associated with you was removed or disabled due to mistake or misidentification, you may submit a counter-notice. A counter-notice must include the following:

  1. Identification of the material that has been removed or disabled and the location where it appeared before it was removed or disabled (for example, the URL).
  2. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for the judicial district in which NCAA Store Online is located, and that you will accept service of process from the person who provided the original notice.
  5. Your physical or electronic signature.

If we receive a valid counter-notice, we may forward it to the original complaining party. Unless the rights owner files an action seeking a court order against the party who submitted the counter-notice, we may restore access to the material within 10 to 14 business days (or longer where required) after receipt of the counter-notice.

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including attorney’s fees.
